General terms and conditions of sale

Part I — Common provisions
I-1. Identification
JUDVI, a French simplified joint-stock company (SAS) with a share capital of €4,000,000, Caen Trade and Companies Register (RCS) no. 807 543 863, VAT no. FR50807543863, whose registered office is at 1776 Route d'Orbois, Le Bû, 14240 Aurseulles (hereinafter "JUDVI").
I-2. Purpose and acceptance
These terms govern JUDVI's services: private hire of the estate (Part II), events open to participation (Part III) and hotel accommodation (Part IV). They are accepted by signing the quotation (devis) or the contract, or by ticking the box provided at the time of online booking.
I-3. Prices and VAT
Prices are stated in euros, all taxes included. The breakdown by VAT rate appears on the invoice. The tourist tax (taxe de séjour), collected on behalf of the municipality, is not subject to VAT.
I-4. Payment
The price is payable according to the payment schedule (échéancier) stated in the quotation or the contract. The date of actual receipt of the funds is authoritative. In the event of late payment: penalties at three times the statutory interest rate and, for business clients, a fixed recovery indemnity of €40 (art. L441-10 of the French commercial code). No discount is granted for early payment.
I-5. Liability and insurance
The Client is liable for damage caused by the Client, the Client's guests and the Client's service providers. The Client declares that they hold civil liability insurance and provides proof upon request.
I-6. Personal data
The data collected are used for the management of bookings, for invoicing and for legal obligations. The Client has a right of access, rectification and deletion at the address indicated on the website.
I-7. Consumer mediation
After a written complaint to JUDVI has remained unresolved, the consumer client may refer the matter, free of charge, to the consumer mediator (médiateur de la consommation): Avenir Conso — 197 Boulevard Saint-Germain, 75007 Paris — www.avenir-conso.com. The referral (saisine) is made online (www.avenir-conso.com) or by post, within one year of the written complaint addressed to JUDVI (art. L612-1 et seq. of the French consumer code).
I-8. Applicable law and language
These terms are governed by French law. In the event of any discrepancy between language versions, the French version prevails.
Part II — Private hire of the estate
II-1. Option and booking
A date may be held as a free option for 14 days. The booking becomes firm upon signature of the contract together with the first payment.
II-2. Price and payment schedule
The price and the payment schedule (échéancier) are stated in the contract. Any instalment whose due date has already passed on the day of signature is payable upon signature. The balance is payable no later than the date stated in the contract. Failing this, JUDVI sends a formal notice (mise en demeure); after a period of eight days, it may terminate the contract, article II-3 then applying.
II-3. Cancellation by the Client
Any cancellation must be notified in writing.
Cancellation within 14 days of signature: full refund, for contracts concluded more than six months before the event.
After this period:
1. the amounts paid remain vested in JUDVI, up to the limit of the instalments due (dans la limite de l'échéancier exigible), as a fixed termination indemnity (indemnité forfaitaire de résiliation);
2. the instalments due on the day of cancellation remain payable;
3. amounts paid beyond the schedule are refunded within 30 days.
A termination statement (décompte de résiliation) is provided to the Client.
II-4. Postponement
The date may be postponed once free of charge, within 18 months of the initial date and subject to availability. Any request made after the 30th day before the event is treated as a cancellation. A second postponement is possible subject to a postponement fee and repricing.
II-5. Cancellation by JUDVI
In the event of force majeure or inability to host the event, JUDVI offers a new date or refunds in full the amounts paid, to the exclusion of any other compensation.
II-6. Conduct and safety
The Client designates a person in charge who is present throughout the event. The Client complies with the venue's capacity, the safety instructions and the integrity of the premises. Only one event is hosted at a time.
II-7. Damage and restoration
The premises are returned in their initial state. Damage, losses and exceptional cleaning are invoiced at actual cost, upon supporting documents.
II-8. External service providers
The Client freely chooses the Client's service providers. The Client communicates them to JUDVI at least 15 days before the event and provides their professional civil liability insurance certificates. Each provider handles its own installation, dismantling and waste removal on the same day.
II-9. Music and quiet
Amplified music outdoors ceases at 11:00 p.m. It may continue indoors until 4:00 a.m., with doors and windows closed. JUDVI may stop any music in the event of a breach or nuisance.
II-10. Accommodation
Where the contract includes the dormitory in the private hire, it is invoiced under the contract; the tourist tax (taxe de séjour) remains due in addition, per adult and per night, paid on site. Any other accommodation — château rooms, or the dormitory outside a private hire — is the subject of separate bookings, governed by Part IV and invoiced separately.
II-11. Alcoholic beverages
JUDVI does not sell alcoholic beverages. The Client may bring them; serving them is the responsibility of the Client or of the Client's caterer. Serving them to minors or to intoxicated persons is prohibited. JUDVI may stop the service in the event of danger.
Part III — Events open to participation
III-1. Registration and payment
Registration is firm upon online payment, which constitutes acceptance of these terms. A payment confirmation is sent by e-mail.
III-2. No right of withdrawal
Leisure services provided on a specific date are not subject to the right of withdrawal (droit de rétractation) (art. L221-28 12° of the French consumer code).
III-3. Cancellation by the participant
Places are neither cancellable nor refundable. They may be transferred to a third party until the day before the event, by simple e-mail notification.
III-4. Cancellation by JUDVI
JUDVI may cancel an event, in particular if the minimum number of participants is not reached or in the event of force majeure. Places are then refunded in full.
III-5. Conduct
Participants comply with the safety instructions. Minors are accompanied by a responsible adult, unless stated otherwise in the event description.
Part IV — Hotel accommodation
IV-1. Booking and payment
The booking is confirmed after registration of the payment or of the guarantee requested, according to the chosen rate. Non-refundable rates are owed in full from the time of booking — excluding the tourist tax (art. IV-4) — and give rise to no refund.
IV-2. Arrival and departure
Arrival and departure times are indicated in the booking confirmation.
IV-3. Cancellation and no-show
Non-refundable rate: in the event of cancellation or no-show, the price of the stay remains due in full; any amounts already paid remain vested in JUDVI.
Other rates: any late cancellation or no-show gives rise to an indemnity equal to one night's stay.
IV-4. Tourist tax
The tourist tax (taxe de séjour) is due per adult and per night, at the rate in force. It is paid on site and is never included in a prepayment. It is not due in the absence of a stay.
IV-5. Invoice
An invoice is provided upon request or at departure.
IV-6. Quiet
Quiet is requested in the accommodation buildings from 11:00 p.m.
